DMCA, IP, and Copyright Policy

 

OBELISK PATCHES is committed to respecting the intellectual property rights of others. We understand that our patches may sometimes feature designs inspired by or incorporating elements that could be protected by copyright, trademark, or other intellectual property laws.

It is our policy to promptly investigate and remove any product from our shop that is found to infringe upon the intellectual property rights of others. We aim to operate in full compliance with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.

 

Our Stance on Intellectual Property

 

  • Respect for Rights: We believe in fostering a creative environment while upholding the rights of creators and intellectual property owners.

  • Good Faith Efforts: We make good faith efforts to ensure that the designs we sell do not infringe on existing copyrights or trademarks. However, given the vast number of creative works, unintentional infringements may occur.

  • Prompt Action: Upon receiving a valid and complete notification of alleged infringement, we will act swiftly to review and, if appropriate, remove the infringing material from our shop.

 

Reporting Intellectual Property Infringement (DMCA Take-Down Notice)

 

If you believe that any product sold on our shop infringes upon your copyright, trademark, or other intellectual property rights, please send a NOTICE to us with the following information:

  1. Identification of the Copyrighted Work or Intellectual Property: A detailed description of the copyrighted work or intellectual property that you claim has been infringed, including registration numbers if applicable.

  2. Identification of the Allegedly Infringing Material: Specific identification of the product(s) or material on our shop that you claim is infringing, including its URL or a clear description that allows us to locate it.

  3. Your Contact Information: Your full legal name, mailing address, telephone number, and email address.

  4. A Statement of Good Faith Belief: A statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  5. A Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

  6. Your Electronic or Physical Signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.

Our Response to Infringement Claims

 

Upon receipt of a complete and valid DMCA Take-Down Notice, we will:

  1. Promptly investigate the claim.

  2. Remove or disable access to the allegedly infringing material.

  3. Notify the seller/designer of the removed material (if applicable) about the claim and provide them with a copy of your notice.

  4. Take appropriate action as required by law.
